Terms of Use

By downloading or using Exigu, you agree to these Terms of Use. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Exigu mobile application available on Android and iOS. By installing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, classroom, or institutional use on devices you own or control.

You may not:

  • Copy, modify, or distribute the App or any portion of it.
  • Reverse-engineer, decompile, or disassemble the App.
  • Use the App to create a competing product or service.
  • Remove or alter any proprietary notices or labels.
  • Use the App in any way that violates applicable laws or regulations.

3. Acceptable Use

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You are solely responsible for:

  • The accuracy of exam content, answer keys, and examinee records you enter.
  • The legibility and print quality of answer sheets you distribute for scanning.
  • Exam integrity — proctoring, seating, and preventing copying are your responsibility; Exigu provides randomization and sheet versioning as tools, not guarantees.
  • Backing up your data — Exigu holds no copies and cannot recover lost data.

4. Scanning & Scoring Accuracy

Exigu's optical-mark-recognition (OMR) scanning is not guaranteed to be error-free. Read accuracy depends on factors outside our control, including print quality, lighting conditions, camera hardware, and how the answer sheet was marked or handled.

Exigu flags marks it isn't confident about — unclear, multiple, or blank — for Manual Review, and a score is only finalized once every flagged item is resolved. You are responsible for reviewing flagged items and for verifying scores before they're used for grading, certification, or any official record.

Exigu is a grading aid, not a certified assessment or fiscal instrument. If your use case requires officially certified test administration or scoring, you are solely responsible for meeting those requirements independently of the App.

5. In-App Purchases

The App offers a one-time in-app purchase, Remove Ads (priced per Google Play / App Store storefront), which permanently removes the App Open ad and unlocks fully offline use. There is no other feature gate — every other feature of the App is available for free.

  • Purchases are processed by Google Play (Android) or Apple App Store (iOS).
  • The purchase is tied to your Google Play or Apple ID account and can be restored on any signed-in device via the Restore Purchase option in Settings.
  • We do not process, store, or have access to your payment information.
  • All purchases are final. Refunds are subject to the policies of the respective app store.

6. Advertisements

Until you remove ads, the App displays a full-screen App Open advertisement on launch, powered by Google AdMob, and requires an internet connection to do so. By using the App before purchasing Remove Ads, you consent to the display of this ad. Purchasing Remove Ads disables it permanently and removes the internet requirement.

7. Printing Answer Sheets

Exigu does not integrate with printer hardware directly. Answer sheets, questionnaires, answer keys, and reports are generated as PDF files for you to print, save, or send using printers or apps of your choosing. We are not responsible for the availability, reliability, or print quality of any third-party printer or app you use this way.

8. Intellectual Property

The App, including its design, code, trademarks, and content, is owned by Exigu and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

  • The App will be error-free or uninterrupted.
  • OMR scans will always read marks correctly, even after Manual Review.
  • Scores, reports, or exports will satisfy any institution's certification or audit requirements.
  • Printing, saving, or sending a PDF through a third-party app or printer will always succeed.
  • Backup files will always restore successfully.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to mis-scored exams, missed grading deadlines, disputed results, or reliance on Exigu's reports as an official or legal record.

Our total liability for any claim shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.

11. Termination

We reserve the right to discontinue the App or any feature at any time without notice. You may stop using the App at any time by deleting it from your device.

12. Governing Law

These Terms are governed by applicable local law in the jurisdiction where you reside, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the courts of competent jurisdiction in your region.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
